Edward Schmidt, whose pregnant wife and three children were killed in a car accident last year, sued the driver of the other vehicle in a wrongful death lawsuit.
According to county prosecutors, the other driver, Sean Woulfe, was driving east in his Chevrolet S10 pickup truck at a speed more than 20 mph over the posted limit when he ran a stop sign and crashed into a 2014 Subaru Outback carrying Schmidt's pregnant wife, Lindsey, and their three sons.
Lindsey Schmidt, 29, and their 19-month-old son, Kaleb, were pronounced dead at the scene of the car crash. Four-year-old Weston Schmidt died at the hospital the next day, and 6-year-old Owen Schmidt died two days later, also at the hospital.
The suit alleges Woulfe was driving at an excessive speed, did not yield the right of way and failed to obey a traffic device, control of his car and keep a proper lookout.
